TERMS OF SERVICE AND ONLINE STORE REGULATIONS – ER.YO
§1. General Information
These Terms of Service and Online Store Regulations define the rules for providing electronic services and using the ER.YO online store, operated by ER.YO Sp. z o.o., with its registered office at [ADDRESS], NIP [NIP], REGON [REGON] (hereinafter: the “Service Provider”).
These Terms are drafted in accordance with:
the Act on Providing Services by Electronic Means,
the Consumer Rights Act,
the Polish Civil Code,
the GDPR (EU Regulation 2016/679),
Apple App Store Review Guidelines and Google Play Developer Policies.
The Terms are made available free of charge on the website and within the Application.
§2. Definitions
Application – the ER.YO mobile application available on Apple App Store and Google Play.
Store – the online store (landing page) enabling the purchase of subscriptions outside the Application.
User – a natural person who is at least 18 years old and uses the Application or the Store.
Creator – the sole creator and publisher of content within the Application.
Subscription – paid access to the Creator’s content for a fixed period (4 or 12 months).
§3. Scope of Services
The Service Provider provides services consisting of: a) granting access to digital content published by the Creator, b) handling payments and subscriptions, c) maintaining the technical infrastructure of the Application and the Store.
Users may only view content published by the Creator and cannot upload or publish their own content.
Only one Creator publishes content within the Application.
§4. Technical Requirements
To use the Application, the User must have:
a mobile device with iOS or Android operating system,
Internet access,
an active user account.
To use the Store, an Internet-enabled device with a web browser is required.
§5. Conclusion of the Agreement
The agreement for the provision of electronic services is concluded when: a) a Subscription is purchased in the Application or the Store, b) the User accepts these Terms and the Privacy Policy.
The User is obliged to provide accurate and truthful data.
§6. Subscriptions and Payments
Subscriptions are offered for fixed periods (4 or 12 months).
Subscriptions may be purchased: a) within the Application – via Apple App Store or Google Play in-app purchases, b) outside the Application – via the Store using online payment operators.
Subscription prices in the Application may differ from prices offered in the Store due to commissions charged by Apple and Google.
Subscription fees are payable in advance.
§7. Right of Withdrawal
A User who is a consumer has the right to withdraw from a contract concluded outside the Application within 14 days, provided that access to digital content has not begun.
Once the User starts accessing digital content before the expiry of the 14-day period, the right of withdrawal is lost.
Purchases made via Apple App Store or Google Play are subject to the refund and cancellation policies of those stores.
§8. Complaints
Complaints regarding the operation of the Application or the Store may be submitted electronically to: [EMAIL].
Complaints will be reviewed within 14 days of receipt.
§9. Liability
The Service Provider is liable solely for the proper functioning of the Application and the Store.
The Service Provider is not responsible for content published by the Creator.
Users are not permitted to copy, distribute or share the content.
§10. Personal Data Protection
Personal data is processed in accordance with the Privacy Policy.
The data controller is ER.YO Sp. z o.o.
§11. Final Provisions
These Terms may be amended for valid legal or technical reasons.
Amendments enter into force upon publication.
These Terms are governed by Polish law.
Any disputes shall be resolved by the court having jurisdiction over the Service Provider’s registered office.
